1. Introduction

Welcome to Bargain City. These Terms of Service govern your access to and use of our website, products and services.

Bargain City sells mobile phones and related products, including Apple iPhones and Samsung devices. Our stock may include brand-new, sealed-box, refurbished and second-hand devices.

By using our website, placing an order or purchasing a product from Bargain City, you agree to these Terms of Service, subject to your rights under applicable South African law.

Nothing in these terms is intended to exclude, restrict or override any consumer right that cannot lawfully be excluded.

2. Products and Product Descriptions

We aim to provide accurate product descriptions, photographs, specifications, prices and condition information.

Products may be advertised as brand-new, sealed-box, refurbished or second-hand. Customers should check the advertised condition, storage capacity, model, colour and other relevant specifications before placing an order.

For second-hand devices, cosmetic condition and battery performance may vary according to the particular device and its advertised grade.

Product photographs may be illustrative unless specifically stated otherwise. Customers may contact us before purchasing if they require clarification about a device.

3. Pricing and Availability

All prices are stated in South African rand (ZAR), unless expressly indicated otherwise.

Prices and stock availability may change without notice. However, changes will not ordinarily alter an order that Bargain City has already accepted at an agreed price.

An order is subject to stock availability and confirmation by Bargain City. If a product becomes unavailable after payment, we will contact the customer to discuss an appropriate resolution, including a refund where required by law.

Any additional delivery charges or other applicable costs will be communicated before the customer completes the purchase.

4. Orders and Order Confirmation

Customers must provide accurate contact, delivery and order information.

Bargain City reserves the right to contact customers to verify order details or resolve discrepancies before dispatch.

An order confirmation or payment notification does not necessarily mean that a product has been dispatched. Dispatch will take place in accordance with our delivery arrangements.

If an order cannot be fulfilled, Bargain City will communicate with the customer and handle any resulting refund or other remedy in accordance with applicable law.

5. Payments

Customers must pay using the payment methods made available at checkout or otherwise agreed with Bargain City.

Orders may be held until the required payment has been received and verified. Customers should not assume that a payment is confirmed solely because they have supplied a payment screenshot.

Customers must never share their banking PIN, password or one-time password (OTP) with Bargain City.

Where a payment is unsuccessful, reversed or disputed, Bargain City may need to verify the transaction before processing the order or resolving the matter.

6. Delivery and Collection

Bargain City delivers to customers throughout South Africa using the available delivery options.

6.1 Delivery methods

Depending on availability and the customer's location, delivery may be arranged through:

  • PUDO locker-to-locker.

  • The Courier Guy store-to-store.

  • PostNet branch-to-branch.

Customers must provide accurate delivery details and collect their parcels within the courier's applicable collection period.

6.2 Delivery charges

Our standard delivery charge is R200, unless a different charge is clearly communicated and agreed before the order is finalised.

6.3 Dispatch times

Our usual dispatch arrangements are:

  • Monday to Friday: Orders confirmed before 16:30 are generally dispatched on the same business day. Orders confirmed after 16:30 are generally dispatched on the next business day.

  • Saturday: Orders confirmed before 12:30 may be dispatched on Saturday. Orders confirmed after 12:30 are generally processed on Monday.

  • Sunday: Orders are generally processed on Monday.

These times are dispatch targets and may be affected by stock verification, payment confirmation, public holidays or circumstances outside our reasonable control.

6.4 Estimated delivery times

Delivery is generally estimated at 1–3 business days after dispatch, depending on the courier, destination and operational conditions.

Delivery estimates are not guaranteed arrival dates. Bargain City is not responsible for delays caused by courier operations or other circumstances beyond our reasonable control, but will assist customers with reasonable delivery enquiries.

6.5 Collection in Pretoria

Cash payment and collection are available in Pretoria only by prior arrangement with Bargain City.

7. Inspection Upon Receipt

Customers should inspect their devices and packaging upon receipt and report any apparent damage, missing items or incorrect products as soon as reasonably possible.

Customers should retain their order confirmation, proof of payment and delivery information.

Reporting a problem promptly helps Bargain City investigate it. However, failure to report an issue immediately does not automatically remove any consumer rights that the customer has under applicable law.

8. Returns, Exchanges, Replacements and Refunds

All returns, exchanges, replacements and refunds are handled in accordance with applicable South African consumer protection law and the circumstances of the particular transaction.

8.1 Reporting a problem

Customers should contact Bargain City on WhatsApp at 074 222 2987 to report a fault, request an exchange or replacement, or raise a refund enquiry.

Where reasonably possible, customers should provide:

  • Proof of purchase.

  • The device model and a description of the issue.

  • Photographs or videos, if relevant.

  • Any other reasonable information needed to assess the request.

Customers should contact Bargain City before sending a device back so that return arrangements can be discussed.

8.2 Reporting period

Customers are encouraged to report problems within seven days of receiving the product.

This is a request for prompt reporting and does not override statutory cooling-off rights, applicable return periods or other consumer rights provided by South African law.

8.3 Assessment and possible remedies

Bargain City generally aims to resolve qualifying product issues by offering a replacement device of the same model or store credit, where appropriate and legally permitted.

All requests will be assessed according to the nature of the fault, the condition of the device, the applicable warranty and South African consumer protection law.

Store credit or a replacement will not be imposed where applicable law entitles the customer to a different remedy.

8.4 Bargain City's Assessment of Exchanges, Replacements and Store Credit

Bargain City personally handles and assesses customer requests relating to product faults, exchanges, replacements and store credit.

When a customer reports an issue, Bargain City will consider the available information, the nature of the fault, the condition of the device, the circumstances of the sale, the applicable warranty and the customer's rights under South African law.

Bargain City may request photographs, videos, diagnostic information or a physical inspection of the device where reasonably necessary to determine the nature and cause of the reported issue.

Where a qualifying fault is confirmed, Bargain City will communicate directly with the customer regarding the proposed resolution. Depending on the circumstances, the preferred resolution may be:

  • Replacement: Replacing the customer's current phone with the same model, subject to availability and applicable law.

  • Store credit: Providing store credit for use towards another purchase, where legally permitted and accepted by the customer.

If the same model is unavailable, Bargain City will discuss the available options with the customer and follow any remedy required by law.

Bargain City remains the customer's direct point of contact for product-related complaints and resolutions. Third-party payment providers are not responsible for assessing product faults or deciding the product remedy on Bargain City's behalf.

Nothing in this section removes any refund or other remedy to which a customer is legally entitled under South African law.

8.5 Condition of returned products

Customers should take reasonable care of a device while a return or warranty request is being assessed.

Damage caused by a drop, impact, liquid exposure, misuse or unauthorised repair may affect a claim if that damage caused the reported fault and the exclusion is permitted by law.

Such damage does not automatically invalidate an unrelated claim or remove a customer's statutory rights.

9. Devices and 12-Month Warranty Coverage

9.1 Product Condition and Testing

Bargain City sells two categories of mobile phones:

  • Brand-new devices: New phones supplied in sealed boxes.

  • Second-hand devices: Previously owned and used phones, with condition varying according to the specific device.

Second-hand devices may show cosmetic signs of previous use, and their condition will depend on the particular device and its advertised grade.

Bargain City tests second-hand devices as appropriate before sale to assess their functionality and condition. Customers should review the product description and ask any questions before purchasing if they require additional information about a device's condition.

9.2 12-Month Warranty Coverage

Every device sold by Bargain City is covered by a 12-month warranty from the date of purchase, subject to the conditions outlined below and applicable South African consumer protection law.

This warranty covers qualifying manufacturing defects and functional or hardware faults that arise under normal use during the warranty period.

The warranty applies to brand-new, sealed-box, refurbished and second-hand devices sold by Bargain City.

9.3 Warranty period

The warranty is valid for 12 months from the date of purchase.

Claims submitted after this period will not be covered by this additional 12-month warranty, except where rights or remedies remain available under applicable law.

9.4 Proof of purchase required

Customers must provide a valid Bargain City invoice, receipt or order confirmation when submitting a warranty claim.

Customers must also provide a clear description of the fault. Bargain City may request photographs, videos or a physical inspection of the device to determine the nature and cause of the problem.

9.5 What is covered under warranty

The following issues may be covered, provided the fault is not caused by customer damage, misuse or an excluded circumstance:

  • Manufacturing defects present at the time of sale.

  • Hardware faults arising during normal use, including qualifying battery, charging port, button, microphone, speaker or other internal component faults.

  • Screen or display malfunctions that are not caused by impact, pressure, liquid exposure or misuse.

  • Functional defects that develop during the 12-month warranty period and qualify under the warranty conditions.

  • Warranty claims submitted with valid proof of purchase within the applicable warranty period.

All claims are subject to assessment by Bargain City to establish the nature and cause of the reported fault.

9.6 What is not covered under warranty

The following are generally excluded from warranty coverage where they cause the fault and exclusion is permitted by law:

  • Accidental damage, including drops, impact damage, cracked screens or physical damage.

  • Liquid or moisture damage.

  • Unauthorised repairs, alterations or modifications performed by a third party.

  • Software problems, viruses, unauthorised software modifications or damage caused by user actions, where not otherwise covered by law.

  • Normal wear and tear consistent with the advertised condition and age of the device.

  • Damage caused by misuse, negligence or failure to handle the device appropriately.

  • Devices with tampered, removed, altered or unreadable IMEI or serial numbers where this prevents verification or assessment of the warranty claim.

An excluded condition will not automatically invalidate a claim if the reported fault is unrelated to that condition or the customer has a legal right to a remedy.

9.7 Warranty assessment and resolution

Customers must contact Bargain City via WhatsApp on 074 222 2987 to report a warranty issue.

Bargain City will personally assess the claim and may require the device to be returned for inspection. Customers should not send a device for assessment without first contacting Bargain City to arrange the return.

Where a qualifying fault is confirmed, Bargain City will arrange an appropriate remedy in accordance with the applicable warranty terms and South African law. Depending on the circumstances, this may include replacing the device with the same model or providing store credit where legally permitted and accepted by the customer.

If the same model is unavailable, Bargain City will discuss the available options with the customer. Any remedy required by applicable law will take precedence over these preferred options.

Bargain City will communicate directly with the customer regarding the assessment and proposed resolution.

9.8 Statutory consumer rights

This 12-month warranty applies to every device sold by Bargain City. It does not replace, restrict or reduce any statutory consumer rights or remedies available under South African law.

10. Manufacturer Warranties and Additional Support

Where a product has a separate manufacturer or supplier warranty, its applicable terms may also be relevant.

The existence of a manufacturer or supplier warranty does not remove Bargain City's responsibilities to customers under applicable South African law.

Customers may contact Bargain City for assistance in understanding the applicable warranty arrangements for their purchase.

11. Customer Responsibilities

Customers are responsible for:

  • Providing accurate order, contact and delivery information.

  • Ensuring that they have selected the correct model, storage capacity and other product specifications.

  • Using and handling devices responsibly.

  • Keeping proof of purchase and relevant order records.

  • Taking reasonable steps to protect their personal information and device data.

  • Cooperating reasonably with product, return and warranty assessments.

Customers should back up their data before handing a device over for inspection or repair. Bargain City cannot guarantee that personal data will remain intact during diagnostic or repair procedures.

Customers should remove personal accounts and security locks when reasonably necessary for an authorised inspection or repair, while taking appropriate precautions to protect their information.

12. Privacy and Personal Information

Bargain City aims to handle customers' personal information responsibly and in accordance with applicable South African privacy law, including the Protection of Personal Information Act (POPIA), where applicable.

Personal information may be used for purposes such as:

  • Processing and fulfilling orders.

  • Arranging delivery and communicating with customers.

  • Verifying payments and transactions.

  • Handling returns, complaints and warranty claims.

  • Meeting applicable legal and regulatory obligations.

Information may be shared with service providers where reasonably necessary to complete a transaction, deliver an order or provide a requested service, subject to applicable law.

Customers should not send confidential banking credentials, passwords, PINs or OTPs to Bargain City.

13. Website Use and Intellectual Property

Website content, including text, photographs, branding, logos and other materials, may be protected by intellectual property laws.

Customers may use the website for lawful personal shopping and related purposes. Website content may not be copied, reproduced, distributed or commercially exploited without appropriate permission, except where permitted by law.

Customers must not misuse the website, interfere with its operation, submit fraudulent orders or engage in unlawful activity through our services.

14. Third-Party Services and Links

Bargain City may use third-party services for payment processing, delivery, communications or other operational purposes.

Third-party services may be subject to their own terms and conditions. Bargain City is not responsible for matters outside its reasonable control, subject to any obligations imposed by applicable law.

Product-related complaints, warranty assessments and requests for exchanges, replacements or store credit should be directed to Bargain City using the contact details provided in these terms.

15. Limitation of Liability

Bargain City will take reasonable steps to provide accurate product information and fulfil accepted orders.

To the extent permitted by law, Bargain City is not responsible for indirect losses arising from circumstances beyond its reasonable control, including courier delays, temporary website interruptions or third-party service disruptions.

Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for consumer rights and remedies that cannot lawfully be waived.

16. Events Beyond Our Control

Bargain City will not be considered in breach of these terms solely because performance is delayed by events beyond its reasonable control, such as severe weather, transport disruptions, power or network outages, strikes or other significant operational interruptions.

We will take reasonable steps to communicate material delays and resume performance when reasonably possible.

This section does not remove any refund or other rights that customers may have under applicable law if an order cannot be fulfilled.

17. Complaints and Dispute Resolution

Customers are encouraged to contact Bargain City directly to resolve questions, complaints or disputes.

WhatsApp/Telephone: 074 222 2987
Email: Bargaincityma7@gmail.com
Website: https://www.bargaincity.co.za

Please provide your order details, proof of purchase and a clear explanation of the issue so that we can investigate it.

Nothing in this section prevents a customer from exercising statutory rights or approaching a competent consumer-protection body or court where appropriate.

18. Changes to These Terms

Bargain City may update these Terms of Service from time to time to reflect changes to its business operations, products, services or legal obligations.

The updated version will be published on our website with a revised update date.

Changes will not remove statutory rights or retrospectively alter an accepted transaction in a way that is contrary to applicable law.

19. Governing Law and Consumer Protection

These Terms of Service are governed by the laws of the Republic of South Africa.

Where applicable, the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, POPIA and other relevant South African laws may apply to transactions and services provided by Bargain City.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Nothing in these terms is intended to waive, exclude or restrict a customer's non-waivable statutory rights.
